In addition to its positive aspects and advantages for the development of our society, digitisation unfortunately also has many dark sides. To a large extent, togetherness takes place via digital media, where the inhibition threshold is quickly lowered because people no longer have to look each other in the face. In the past, there was a netiquette that made appreciative interaction with one another on the Internet a maxim. Today, although many social media providers have a netiquette on their site, it is no more than lip service. The brutalization and often inhuman treatment of each other by young people causes me great concern: If this treatment becomes normal, if parents even set an example to their children, a generation will grow up that considers this treatment as normal. Judgments such as the one just passed in the Künast case confirm the public image. In addition, there is often little communication at home, because many adults are now almost exclusively on the move digitally and welcome this with their children in order to have peace and quiet. For the most part, parents have no idea what content their children will encounter on their smartphone, for example, what they are doing there.

The parental home would have to make the essential contribution here to set the course at an early age. School only cannot do this, especially since infringements of rights do not usually happen during school hours. But adults are largely ignorant about how to deal with digital media. In addition, adults also lack mutual appreciation and open, constructive criticism (see parents’ WhatsApp groups) – in other words, they are showing their children how to do it. If their own child becomes a perpetrator, they don’t want to believe it and protect their child instead of showing him or her another way.

On the other hand, people are less likely to like and comment, probably because they are afraid of hate comments or even a shit storm – this is also dangerous for our democracy, as it means that the hater will get more attention. It seems that they are in the majority, which is not the case at all. But too few speak out openly against hate on the internet because of fear – the silent mass is big.

Digitisation is leading to phenomena that are almost impossible to control today. Cyber-grooming, the planning phase between a child and an adult to be followed by a sexual assault, is not only taking place today in online games, but also via WhatsApp, Instagram, Facebook, TikTok and other portals. Hate Speech on the Internet, the amount of hate commentary today confronts the police and public prosecution offices with tasks that are actually impossible to solve. Cyberbullying, sexting, cyber stalking, even here a lot remains hidden, is not provable. Disposable e-mail addresses are used, groups are opened without the person knowing that he or she is affected. Today, these cases lead to lifelong consequences for those affected, due to the proliferation on the Internet. If, for example, nude photos are involved and the person concerned comes from a Turkish or Syrian family – I have had exactly these cases in my law firm – then there are far-reaching consequences if there is a threat like “We will send this to your whole family”. Photos or videos are now distributed via WhatsApp, Facebook, Instagram, and often involve crimes under 22, 33 art copyright laws or 201a StGB, and few people, including many adults, know this. Recently the raid, nationwide, where child pornographic videos were found and the perpetrators were 14 to 26 years old. I assume that these videos were also made by schoolgirls themselves and if they are under 14 years old, it is child pornography. This is new today, that parents have to expect that the police will be at their door and say their son or daughter is suspected of possessing or having distributed child pornography. Our parents did not have to fear this in the past. In the past it was enough to say, “You must not hit, not steal, not break anything and not cross the street at red lights”. But unfortunately that is no longer enough today.

I have been using the format live webinar at schools nationwide since 2013 and I am a big fan of this format because it has several advantages. On the one hand, I can present the content of my topics at many schools simultaneously: Cyberbullying, sexting, right to one’s own image, cyber grooming. From 2014 to 2019 I have held about 1,200 seminars and reached about 72,000 people and I personally could never have done that. Another advantage is that the format offers a certain anonymity for the audience and this is very advantageous for the pupils, because when I beam out of the room at the push of a button, they are alone with the teacher, class teacher, guidance counsellor or school social worker. And then they open up, then they talk about their own experiences, because the subjects I teach them are what they deal with in their free time day after day. Live webinars are also preferable to a YouTube video. I was told, why not put a video on YouTube? But the webinar changes every day. I can incorporate new judgements, new cases, new legal regulations on a daily basis, so the webinar has changed massively since 2013. Putting a video up on YouTube would be static and does not bring personal exchange. And finally also the time aspect: 200 webinars per year, that is pure consulting hours of 300 hours, 25 hours per month. If I would go to the schools personally, there would be many, many hours for travelling to and from the schools. There are also apps, applications like Love Storm for example, where you can report hate comments, that you can basically make it clearer how much hate there is on the Internet. This report alone is already a step in the right direction, to uncover it and to make it conscious and to look, how can we take action against it. Love Storm also offers online training on the topic of how to do something against hate comments.

My vision of prevention in the future, in the digital world, is that all actors network and cooperate nationwide, which unfortunately is not yet happening. This would enable us to create great synergy effects, learn from each other and there are enough fields of activity for everyone. Nobody is going to take anything away from anybody, but I have the impression at the moment that this might be an obstacle to cooperation. Then another vision is that more money should be made available for prevention, because I do not believe that demanding higher penalties and stricter laws will achieve the desired effect, because by then it will already be too late. That is why more money for prevention would certainly be important. Ideally, training materials or prevention concepts should be made available as OER, i.e. as open education research, so that everyone can benefit from them nationwide. And also to ensure the creation of these materials and their provision through state funding. And finally, what is very important to me, cyberbullying, for example, is of course also transferred into the classroom atmosphere. Even if it takes place in the digital world, it is transmitted into the classroom, and that’s where I think school social workers are very important today, and will be very important in the future. I hope that school social work will become a permanent element in schools and that it will be recognised, respected and financially secured and not remain tied to ESF funding. And thus become a stable pillar in the school. I am also very concerned about a current development, what is shared in WhatsApp class groups from the fifth and sixth grade up to the eleventh and twelfth grade: Swastikas, Hitler salute pictures, “Willst Du Spaß brauchst Du Gas”, pictures of Anne Frank with “Lolokaust” written above them. These pictures, these stickers are shared, a hundred times. Pupils think it is fun, but it is a criminal offence to share such content. Parents do not know that children share such things today and therefore cannot react to them at all, and that is why we have to educate, sensitise and communicate the criminal offences.
