Digitisation is leading to phenomena that are almost impossible to control today. Cyber-grooming, the planning phase between a child and an adult to be followed by a sexual assault, is not only taking place today in online games, but also via WhatsApp, Instagram, Facebook, TikTok and other portals. Hate Speech on the Internet, the amount of hate commentary today confronts the police and public prosecution offices with tasks that are actually impossible to solve. Cyberbullying, sexting, cyber stalking, even here a lot remains hidden, is not provable. Disposable e-mail addresses are used, groups are opened without the person knowing that he or she is affected. Today, these cases lead to lifelong consequences for those affected, due to the proliferation on the Internet. If, for example, nude photos are involved and the person concerned comes from a Turkish or Syrian family – I have had exactly these cases in my law firm – then there are far-reaching consequences if there is a threat like “We will send this to your whole family”. Photos or videos are now distributed via WhatsApp, Facebook, Instagram, and often involve crimes under 22, 33 art copyright laws or 201a StGB, and few people, including many adults, know this. Recently the raid, nationwide, where child pornographic videos were found and the perpetrators were 14 to 26 years old. I assume that these videos were also made by schoolgirls themselves and if they are under 14 years old, it is child pornography. This is new today, that parents have to expect that the police will be at their door and say their son or daughter is suspected of possessing or having distributed child pornography. Our parents did not have to fear this in the past. In the past it was enough to say, “You must not hit, not steal, not break anything and not cross the street at red lights”. But unfortunately that is no longer enough today.
